Tema: Justicia Autónoma
"En la justica de la otra no hay amiguismo, parentesco, favoritismo ni
tampoco la justicia se vende , el acusado aun siendo hermano de la
autoridad cumple su condena de acuerdo a su delito "
"En la justicia mexicana no habrá funcionario, que no se llene los
bolsillos y que imparta justica verdadera , por eso el pueblo es el
que tiene que hacerlo"
Al inicio de la clase y por peticiones de (nosotros un día antes) los
alumnos cibernéticos de que nos dieran sus nombres para saber cómo
llamarles , estos maestros tomándonos en cuenta accedieron
humildemente y así Gabriel, Valentina, Filiberto, Mari , Marlene y
Doroteo comenzaron la clase y no cabe duda que encada clase que estos
maestros zapatistas nos dan se aprenden más cosas de autonomía ,
rebeldía , democracia y justica y también nos demuestran que sin el
mal gobierno ellos pueden hacer la otra justicia. Una justicia que no
se vende ni se corrompe ni mucho menos hay influencia ni oportunidad
para quebrantarla y pisotearla favoreciendo a los más ricos . L@s
zapatistas , han implementado su propio método de hacer justica a su
manera efectiva y nos explican cómo funciona . Primero si el delito es
menor, una borrachera o el robo de una animal el caso será local y la
pena será pagar el animal si todavía existe y si no la multa no será
en dinero si no en trabajo colectivo y para beneficio del pueblo , en
el caso de emborracharse será suficiente una llamada de atención y si
los infractores son renuentes , no entienden o no aceptan culpabilidad
, el caso es llevado a otro nivel y es mandado al municipio .Si el
caso es más grave por ejemplo de violación o asesinato el caso es
mandado al nivel más alto , La junta de buen gobierno ,y allí se
toman cartas en el asunto valiéndose de todos los involucrados
incluyendo los tres niveles y los familiares testigos y testimonios de
todas estas personas , allí si se multa al agresor y este tendrá que
mantener a su familia y a la familia de la víctima, teniendo la
oportunidad ambas partes de llegar a un arreglo sin que el gobierno y
justica tome parte pero firmado correctamente , si hay multa esta es
destinada a las necesidades del pueblo al igual que si se multa en los
municipios el otro nivel de justicia . En la justicia Zapatista la
autoridad no es la que señala y culpa al acusado si no los hechos y
los testigos, ni tampoco se le puede dar dinero al juez como nos
cuentan. Algo que me llamo la atención es el castigo para aquellas
personas que se emborrachan pues dicen ellos que en la comunidad
zapatista es un delito emborracharse y que ellos saben perfectamente
que eso no ayuda al pueblo o a la familia si no que más que nada lo
perjudica. A pesar de que han sido criticados por no respetar los
derechos civiles ellos están seguros de que están en lo correcto y
ejerciendo su autonomía. No cabe duda que con este acto demuestras el
avance, visión y conciencia que tienen ya que si efectivamente el
alcohol es una fuga para olvidarse de los problemas y es también ( y
ellos lo saben ) una arma que el gobierno usa para distraerlos . Saben
también que el gobierno les da televisión ; Novelas y deportes para el
mismo fin, embrutecerlos igual que el alcohol . Hace tiempo Venezuela
con su presidente de verdadera izquierda Hugo Chávez, en un acto
aplaudible ,saco del aire las novelas mexicanas, y el nefasto talk
show de la señorita Laura y prohibió que las difusoras radiales
tocaran reguerón en una sabia acción para la defensa del pueblo ya que
se dieron cuenta de que eso contamina el cerebro al grado de convertir
a los jóvenes , adultos y ancianos en verdaderos mongoles carentes de
opinión , títeres de trapo sin pensamiento crítico o analítico .
Cuba siguió los pasos y Bolivia también recibiendo el pago de
dictadores por aquellos dementes que controlan al mundo y sus serviles
vasallos los presidentes de algunos países incluyendo al presidente
Pena Nieto de México.
No quiere decir que todo sea color de rosa ya que también tiene sus
problemas, tales como la manutención de los presos , comida y techo o
tenerlos vigilados siempre ya que ha habido casos que el reo se
escapa. Estos son algunos de los problemas que enfrentan debido a la
falta de recursos. Nos cuentan que ellos tienen muchas ideas pero no
los recursos para llevarlas a cabo, a los presos se les da talleres o
enseñanzas de oficios y al final ellos agradecen por el haberles
ensenado algo en el tiempo que estuvieron pagando su delito.
L@s zaptistas sin conocer mucho de otros países y abecés sin siquiera
hablar castellano, gana sabiduría mediante las experiencia vividas al
rojo vivo y a todo color, por eso están fuera de las novelas para
vivir su propia vida y hacer la otra forma de gobierno que les
funciona. Cuentan en su clase también que algunas veces los coyotes
que trafican por sus tierras se aprovecha de los emigrantes que viene
de otros países y eso no les gusta a ellos y así abecés los agarran y
los hacen pagar y regresar el dinero que les cobran a los emigrantes,
así también les brindan un taco o alojamiento humilde a los emigrantes
que transitan por sus tierras y son rescatados, ellos quisieran hacer
más pero no tiene recursos, señalan .
Así queda claro que no es igual resolver el problema o delito, a nivel
local, municipal o en la junta de buen gobierno, siempre aplicando la
razón como justicia y esta justicia se aplica de manera diferente de
y en sus tres niveles y de acuerdo a la gravedad del crimen que van
desde una borrachera, problemas intrafamiliares, robo de animales,
disputa de tierras y asesinatos.
El valor de eso hombres y mujeres zapatistas es de admirarse y
reconocerse se, ya que sin pelos en la lengua y con pruebas acusan y
critican al gobierno por nuestra situación y de cómo tiene a los
mexicanos ( NO ALOS ZAPTISTAS) en esa miseria , ignorancia y olvido.
Ellos, así como no creen en la politiquería, tampoco creen en la
justica mexicana ya que hay mucha diferencia entre la justica que
ellos practican a la que el gobierno práctica. Dicen ellos que los
verdaderos delincuentes están afuera y abecés hasta premiados , ponen
como ejemplo el caso de Enrique Peña Nieto presidente de México
,que aun que cometió violaciones y crimen en el caso Atenco cuando era
gobernador ,fue premiado con el puesto de presidente . O Cedillo ex
presidente mexicano, en el caso Acteal que no recibo castigo y fue
reconocido por varias cosas, viviendo cómodamente y ahora impartiendo
clases en una universidad de USA. Mientras que varios compas han sido
asesinados o puestos tras las rejas por el único delito de
organizarse, tal es el caso del profesor Alberto Patihstan

crimen que se le fabrico y ya lleva varios años en prisión , así como
el de michos comas más, afirman . Así funciona la justicia que ellos
crean para su propio beneficio y han inventado algo llamado fuero ,
que los ampara de sus delitos , en esa justicia hay corrupción y se
puede compra a jueces y policías y los culpables, si tiene dinero ,
influencias o son políticos salen libres.
L@s zaptistas Reconocen que solo la organización y acción pueden hacer
el cambio ya que es sabido por tod@s zapatistas y no zapatistas que
habrá gobernante que en realidad ayuden al pueblo y que es
responsabilidad de todos hacer el cambio, allá en las comunidades
indígenas chapanecas ya se está haciendo y construyendo la otra
dignidad y esperanza desde hace 19 años demostrando que otra vida es
posible.
Digo yo que es totalmente cierto todas estas verdades que dicen los
zapatistas y caen como balde de agua, pues si somos cobarde y solo
criticamos nos quejamos y no actuamos y es cierto que los verdaderos
ladrones están en el poder y que salen libres por falta de pruebas y
corrompiendo la justicia que supuesta mente hay pero que solo sirve a
ellos. Es cierto que a los que nos organizamos y protestamos nos
encarcelan usando toda clase de recursos malsanos y criminales para
acallarnos, es cierto que nos asesina , desaparecen y así nos infunden
terror , todo eso es cierto . El día que nosotros despertemos asi como
los zapatistas ese día cambiara todo , agrego una frase que vi por
allí "Cada país tiene el gobierno que merece"
La clase termino después de una rueda de preguntas que se formularon
en el receso en donde se tocaban las canciones revolucionarias a
luciendo la lucha social y zapatista así como pequeños trabajos en
video de las acciones zapatista ( La marcha silenciosa por ejemplo )
,Y los humildes y sabios zapatistas nos respondieron a su manera de
ver la otra justica y con su palabra salida desde lo mas profundo de
su corazón .

Unlike the Capitalistic Mexican Justice System, you cannot buy Zapatista Justice

With so many of their comrades having being murdered by people who are
never punished, or else get exonerated and released (like the ones who
committed the Acteal massacre), Zapatistas know about corruption in
the capitalistic judicial system.

They know about comrades being arrested under false charges, tortured,
forced to sign false confession statements, judged by corrupted judges
and serving lifetime condemns for crimes they did not commit.

Criminals like the brother of Mexican President Carlos Salinas de
Gortari, accused of drug smuggling and unlawful enrichment (more than
$120 millions US DOLLARS), has just been exonerated of all his crimes
two weeks ago, while rural Zapatista teacher Alberto Patishtán still
serves an illegal sentence for crimes he did not commit.

So Zapatistas know about justice being bought. That's why they
developed mechanisms to create a judicial system that is not about
money.

In the fourth class on Freedom According to Zapatistas, they talked
about how their system avoids favoritism and bribes.

"We call it 'the other justice' because there is a big difference with
the official "justice" system. The Zapatista justice is
non-negotiable, as opposed to the Mexican justice system from the
political parties, where people can pay for justice. It is a judicial
system that allows settlements by personal friendship, money, and
corruption. You need to have money to pay a lawyer and all the
corrupted officers."

"In the non-Zapatista communities, there is no financial treasurer,
which means the police authorities are not accountable for the money
they get," they explained.

That does not happen in the autonomous justice system. No payments are
allowed. There is accountability and information. While the Mexican
judicial system manages to turn every step of the process into a
business with side settlements, bribes and unofficial fines, the
Zapatista system makes sure that fines and penalties (consisting in
several days of work for the community, depending on the felony)
compensate the aggrieved person or family.

While each community develops their own regulations, they all follow
the seven government principles.

The local authorities deal with minor offences. More serious crimes
are referred to the municipality or the government board. In every
case, it is never about one person deciding on a sentence, but about
investigating, communicating, educating, trying different solutions
and agreements, and then deciding a penalty. There is no such thing as
police arresting people with no warrant, then violating the prisoner's
human rights, and then a judge deciding. Actually, when a crime is
committed, the authorities try to talk to the family and friends of
the accused person to persuade him/her so that he/her turns himself to
the authorities.

In cases of serious crimes (like murder), the agents arrest the person
and start an investigation along with a consultation with every
officer and every person involved about the possible punishment.
However, in the meantime the authorities can facilitate that the
family of the murdered person and the family of the murderer get to an
understanding. It takes time, but they facilitate the possibility
that the affected people and the offender decide on the punishment.
"The families talk to each other. Some families think - what is the
purpose of putting in jail the murderer? I won't have my son back. So
they agree on some other punishment. A murderer serves sentence
working to provide for his family and the family of the affected
people. So the authority is just a mediator".

"It is not easy, that's one example, it not always happens that way.
Another time, we arrested the person and the person escaped before we
could reach an agreement why? Because we don't have always resources,
so we asked the community to let us know if they find the criminal.

"We don't always have a place to detain the criminal, to feed him. So
this is how it works for us right now."

They also talked about punishment for human smugglers who abuse the
immigrants from other countries (entering from Guatemala) on their way
to the US.

They stressed that it is an incipient system lacking many resources,
but they have the vision of turning it into a complete rehab system,
unlike the official Mexican system where people learn more crime and
drug smuggling in jail than outside.

"Aside from the fact that our justice is applied by collective
agreement, our justice does not discriminate by race, language, genre
. . . the prisoner eats exactly the same that the authority eats, if
the authority officer eats meat, the prisoner eats meat . . . In the
official justice system, prisoners of a higher social class have
banquets in jail while the others have bad food."

"Those are the differences between the official justice system and
Zapatista judiciary system, and we did not study that anywhere, in any
Code, we learned from experience and from the community."

Those were, in short, the main points of today's class.

iconic indigenous political prisoner and human rights Zapatista
defender Alberto Patishtán Gómez, who has now served nearly 13 years
of a 60-YEAR sentence for crimes he did not commit.

WHO IS HE?

Alberto Patishtan is a Zapatista Indian Tzotzil teacher from the
village of El Bosque in Chiapas. He was accused by the mayor at the
time, Manuel Gómez Ruiz of participating in an ambush where 7
policemen died in the state. This observation is simply a slander and
a clear political revenge, as teacher Alberto Patishtan had served as
a social activist to be representative of the organization La Canoa,
who watched over the interests of the community and was denouncing the
mayor for illicit enrichment, corruption and abuse of power. This is
the true reason for which he was arbitrarily detained on June 19,
2000, and is now serving an unjust sentence of 60 years, despite
irregularities due process and evidence that proves his innocence. To
date, the real ambushers remain unknown.

On 6 March, the Supreme Court rejected bringing the case to its
jurisdiction, denying the opportunity to correct the injustice
committed against the teacher. With this decision, the Supreme Court
demonstrated a serious legal inconsistency and incompetence by failing
to apply the criteria in favor of human rights.

The case was sent back to the First Appellate Court in Tuxtla
Gutierrez, who had the ability to follow the law and justice and to
finally releasing the teacher. because the Court's decision will be
the last one within national legal instances. For all this, human and
civil rights groups are speaking out. Support them!

These facts alone prove that justice in Mexico is not for Indians, not
for social activists, not for humble people who cannot "pay" their
freedom as politicians and businessmen do.
